Oman Commercial Arbitration Centre provides an additional service for non-OAC administered arbitrations, mediations, and other ADR proceedings, where the role of the OAC would be to act as fundholder.

The scope of the fundholding service to be provided by Oman Commercial Arbitration Centre would include not only fundholding for security for fees and expenses of arbitrators, mediators, experts, and other neutrals but also security for the amount in dispute and security for costs.

Fundholding is a service provided by Oman Commercial Arbitration Centre where it manages the financial aspects of the arbitrations, mediations, and other ADR proceedings on behalf of the tribunal/parties, which includes holding deposits paid by parties towards the costs of the arbitrations, mediations and other ADR proceedings, processing invoices raised by the tribunal and disbursing these payments and providing accounts of such transactions to the tribunal and parties.

Fundholding services provided by institutions can be divided into two broad categories:

  1. Holding security for fees and expenses on behalf of arbitrators, mediators, and adjudicators.
  2. Holding security for the amount in dispute or security for costs as directed by the arbitrators, mediators, and adjudicators.

Oman Commercial Arbitration Centre provides an additional service in arbitrations, mediations, adjudications, expert determinations, and other ADR proceedings, where the role of the OAC would be to act as the Appointing Authority only. This could be pursuant to ad-hoc rules or procedures agreed by the parties; or under the UNCITRAL arbitration rules and other institutional rules; or when requested to do so by a competent court.

The scope of the appointment services provided by the OAC would not be limited only to the appointment of the arbitrators, mediators, experts, and other neutrals but would also include:

  1. The determination of challenges; and
  2. Substitution of arbitrators, mediators, experts, and other neutrals removed by the institution on the basis of a successful challenge, or otherwise.
